Terms and Conditions for GoMyGo Bookings Pvt. Ltd.

1. Introduction

These Terms and Conditions govern the use of the GoMyGo online platform (“Platform”) and the booking of bus tickets (“Tickets”) through the Platform. By accessing or using the Platform, you (“User”) agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use the Platform.  

2. Booking Process

  • Seat Availability: GoMyGo acts as an intermediary between Users and bus operators (“Operators”). Seat availability is subject to change in real-time. GoMyGo does not guarantee seat availability until the booking is confirmed.
  • Booking Confirmation: Upon successful payment, GoMyGo will issue a booking confirmation. This confirmation serves as proof of purchase and should be presented at the time of boarding.
  • Ticket Delivery: Tickets may be delivered electronically (e-tickets) or through other means as specified during the booking process.
  • Payment: Payment for Tickets must be made through the designated payment gateways on the Platform. GoMyGo is not responsible for any issues related to payment processing.

3. GoMyGo’s Responsibilities

  • Seat Allocation: GoMyGo is responsible for ensuring the seats booked by the User are allocated to the User as per the booking confirmation.
  • Platform Maintenance: GoMyGo will endeavor to maintain the Platform and ensure its proper functioning. However, GoMyGo does not guarantee uninterrupted service or the absence of technical issues.

4. Operator’s Responsibilities

  • Bus Operations: Operators are solely responsible for all aspects of bus operations, including but not limited to:
    • Bus maintenance and safety
    • Driver training and conduct
    • On-time departures and arrivals (subject to unforeseen circumstances)
    • Passenger safety and security during the journey
  • Seat Guarantee: Operators are responsible for providing the seats booked through the Platform.

5. User’s Responsibilities

  • Accurate Information: Users are responsible for providing accurate and complete information during the booking process.
  • Travel Documents: Users are responsible for carrying valid identification documents as required by the authorities.
  • Luggage and Belongings: Users are solely responsible for their luggage and belongings during the journey. GoMyGo and Operators shall not be liable for any loss, damage, or theft of luggage or belongings.
  • Safety and Security: Users are responsible for their own safety and security during the journey.
  • Journey Compliance: Users are responsible for complying with all applicable laws, rules, and regulations during the journey.

6. Disclaimer of Warranties

  • No Guarantees: GoMyGo does not guarantee the accuracy, completeness, or reliability of any information provided on the Platform, including but not limited to bus schedules, fares, and operator information.
  • No Warranties: The Platform is provided “as is” without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.  

7. Limitation of Liability  

  • GoMyGo’s Liability: GoMyGo’s liability to the User shall be limited to the amount paid by the User for the Tickets. Under no circumstances shall GoMyGo be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or injury, arising out of or in connection with the use of the Platform or the booking of Tickets.  
  • Operator’s Liability: Users acknowledge and agree that GoMyGo shall not be liable for any acts, omissions, or negligence of the Operators.

8. Indemnification

The User agrees to indemnify and hold harmless GoMyGo, its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising out of or in connection with the User’s use of the Platform, violation of these Terms and Conditions, or any other actions of the User in connection with the booking or travel.  

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Government of Nepal.  

10. Dispute Resolution

Any dispute arising out of or relating to these Terms and Conditions shall be subject to coming to mutual resolution.

11. Changes to Terms and Conditions

GoMyGo reserves the right to modify or amend these Terms and Conditions at any time without prior notice. The updated Terms and Conditions will be effective immediately upon posting on the Platform.

Booking Policy

GoMyGo is a booking platform that ensures the reservation of a seat and vehicle for passengers booked through our platform. However, we do not provide any guarantees regarding bus departure and arrival times, delays, or other unforeseen events. For any support or assistance, GoMyGo is available to assist you. (Support timing- 6:30 AM – 9:30 PM, Sunday-Saturday).

GoMyGo Terms and Conditions (GoMyGo नियम र सर्तहरू)

1. General Terms: By booking through GoMyGo, you agree to the following terms and policies. These policies are applicable to all passengers who book tickets for travel through our platform.

1. सामान्य सर्तहरू: GoMyGo मार्फत बुकिंग गर्दा तपाईंले तलका नियम र सर्तहरू स्वीकार गर्नुहुन्छ। यी नीतिहरू सबै यात्रुहरूका लागि लागू हुन्छ जो हाम्रो प्लेटफर्म मार्फत यात्रा बुक गर्छन्।

2. GoMyGo’s Responsibility: GoMyGo ensures the reservation of a seat and vehicle for the passenger. However, GoMyGo will not be held responsible for any delays, cancellations, or missed trips caused by the bus operators or any other third party. Additionally, GoMyGo does not take responsibility for any delays, cancellations, or other disruptions caused by the passenger or external circumstances.

2. GoMyGo को जिम्मेवारी: GoMyGo ले यात्रुका लागि सिट र सवारीको Guarantee गर्दछ। तथापि, GoMyGo ले कुनै पनि ढिलाइ, रद्दीकरण, वा बस अपरेटर वा अन्य तेस्रो पक्षले गरिएका मिस्ट्रीहरूको लागि जिम्मेवार हुने छैन। थप रूपमा, GoMyGo ले यात्रु वा बाह्य परिस्थितिहरूको कारणले भएको ढिलाइ, रद्दीकरण वा अन्य विघटनहरूको लागि कुनै जिम्मेवारी नलिन्ने छ।

3. Bus Timings and Delays: While GoMyGo aims to provide accurate and timely information, we cannot guarantee the departure or arrival times of the bus. Delays caused by bus operators, weather conditions, or other unforeseen circumstances are beyond our control, and GoMyGo will not be held liable for such delays.

3. बस समय र ढिलाइहरू: GoMyGo ले सही र समयमै जानकारी दिनको लागि प्रयास गर्दछ, हामी बसको प्रस्थान वा आगमन समयको ग्यारेन्टी दिन सक्दैनौं। बस अपरेटर, मौसमको अवस्था, वा अन्य अनपेक्षित कारणहरूले भएको ढिलाइ हाम्रो नियन्त्रण बाहिर छन्, र GoMyGo यस्ता ढिलाइहरूको लागि जिम्मेवार हुनेछैन।

4. Cancellation Policy

  • 100% Refund: Trips must be canceled at least 24 hours before the scheduled departure time to be eligible for a 100% refund.
  • Partial Refund: Trips canceled 12-24 hours before departure may be eligible for a partial refund, based on the terms outlined by the bus operator.
  • No Refund: Trips canceled less than 12 hours before departure will not be eligible for any refund, under any circumstances.

4. रद्दीकरण नीति

  • 100% रिफन्ड: यात्रा प्रस्थानको निर्धारित समय भन्दा 24 घण्टा अघि रद्द गर्दा यात्रुलाई 100% रिफन्ड प्राप्त हुनेछ।
  • आंशिक रिफन्ड: यात्रा 12-24 घण्टा अघि रद्द गर्दा, बस अपरेटरको शर्तहरू अनुसार आंशिक रिफन्ड योग्य हुन सक्छ।
  • केही रिफन्ड छैन: यात्रा 12 घण्टा भन्दा कम समयअघि रद्द गर्दा कुनै पनि रिफन्ड योग्य हुने छैन।

5. Rescheduling Policy

  • No-Cost Rescheduling: Passengers may reschedule their trips up to 12 hours before departure at no extra cost.
  • Cost-Based Rescheduling: Rescheduling a trip after 12 hours before departure may incur additional costs, depending on the situation and availability. Additional fees will be communicated at the time of rescheduling.

5. पुनःसमय निर्धारण नीति

  • शुल्क बिना पुनःसमय निर्धारण: यात्रुहरूले 12 घण्टा अघि यात्रा पुनःसमय निर्धारण गर्दा कुनै अतिरिक्त शुल्क लाग्ने छैन।
  • शुल्क आधारित पुनःसमय निर्धारण: यात्रा 12 घण्टा भन्दा पछि पुनःसमय निर्धारण गर्दा अतिरिक्त शुल्क लाग्न सक्छ, यसमा उपलब्धता र स्थिति अनुसार। पुनःसमय निर्धारणको समयमै शुल्कहरूको जानकारी दिइनेछ।

6. No Show Policy: If a passenger fails to board the bus on time for their scheduled departure, they will be considered a “no-show” and will not be entitled to any refund or compensation.

6. नो शो नीति: यदि कुनै यात्रु निर्धारित प्रस्थान समयमा बस चढ्न विफल रहन्छ भने, उसलाई “नो शो” मानिनेछ र उसलाई कुनै रिफन्ड वा क्षति पूर्ति दिइने छैन।

7. Seat and Vehicle Availability: While GoMyGo ensures the reservation of a seat and vehicle, it is the passenger’s responsibility to ensure they arrive at the departure point on time. GoMyGo is not responsible for any issues arising from failure to adhere to the departure timings.

7. सिट र सवारी उपलब्धता: GoMyGo ले सिट र सवारीको सुनिश्चितता गर्दा, यात्रुहरूको जिम्मेवारी भनेको भनेको प्रस्थान स्थानमा समयमै पुग्नु हो। GoMyGo कुनै पनि मुद्दा वा समस्या जसले यात्रुको प्रस्थान समयसँग मेल नखाने कारणलाई जिम्मेवार हुने छैन।

8. Passenger Responsibility: Passengers must arrive at the departure point on time. GoMyGo will not be responsible for any delays, missed buses, or missed connections caused by the passenger’s tardiness.

8. यात्रुको जिम्मेवारी: यात्रुहरूले प्रस्थान स्थानमा समयमै पुग्नुपर्छ। GoMyGo यात्रुको ढिलाइ, छुटेको बस वा छुटेको जडानको कारणले कुनै जिम्मेवारी नलिन्ने छ।

9. Emergency Situations: In the case of an emergency or a force majeure event (such as weather conditions, political unrest, etc.), GoMyGo will not be responsible for any cancellations or delays caused. Passengers will be informed as soon as possible, and rescheduling or refunds will be handled based on the circumstances.

9. आपतकालीन अवस्थाहरू: आपतकालीन स्थिति वा बल प्रक्षेपण घटनामा (जस्तै मौसम अवस्था, राजनीतिक अशांति, आदि), GoMyGo ले कुनै रद्दीकरण वा ढिलाइको लागि जिम्मेवार नहुन सक्छ। यात्रुहरूलाई चाँडै सूचित गरिनेछ र पुनःसमय निर्धारण वा रिफन्ड परिस्थितिहरूको आधारमा व्यवस्थापन गरिनेछ।

10. Modifications to Terms: GoMyGo reserves the right to modify these terms and policies at any time. Any changes to the terms will be communicated to passengers before their next booking.

10. नियमहरूको संशोधन: GoMyGo ले यी नियम र सर्तहरू कुनै पनि समयमा संशोधन गर्न सक्ने अधिकार राख्छ। कुनै पनि परिवर्तनहरू यात्रुहरूलाई उनीहरूको अर्को बुकिंग अघि सूचित गरिनेछ।

By confirming your booking, you acknowledge that you have read and agree to the above terms and conditions.

तपाईंको बुकिंग पुष्टि गरेर, तपाईंले माथिका नियम र सर्तहरू पढ्नु भएको र सहमति जनाउनु भएको स्वीकार गर्नुहुन्छ।

The above terms and conditions is effective immediately from 2024-01-01 until any further amendments or modifications are published.

माथिका नियम र सर्तहरू 2024-01-01 देखि तत्काल प्रभावले लागू हुनेछन् र कुनै पनि भविष्यको संशोधन वा परिवर्तनहरू प्रकाशित नभएसम्म लागू रहनेछन्।
